On September 28, 2020, the Inquiry Committee (the “Committee”) accepted Ms. Kathleen Oddoux’s proposal to settle an Amended Citation pursuant to s. 37.1 (3) of the Health Professions Act. Ms. Oddoux’s proposal included an admission of misconduct based on her breaching an undertaking, and an agreement that she will not apply for registration until she has completed the terms of that undertaking. 

Background

Ms. Oddoux was, at all material times before January 31, 2020, a registrant of the College, and specifically a speech-language pathologist.

On or about September 27, 2018, a complaint was filed with the College asserting the Ms. Oddoux lacked competency in clinical practice and formal assessment skills. The Committee disposed of the complaint by proposing under­takings which Ms. Oddoux gave, pursuant to an agree­ment dated July 29, 2019 (the “Undertaking Agreement”). 

Under the Undertaking Agreement, Ms. Oddoux undertook to participate in review sessions with a supervisor. The Respondent began her review sessions, but on or about January 7, 2020, Ms. Oddoux voluntarily relinquished her license to retire, rather than complete the requirements of the Undertaking Agreement. She advised the College that she declined to complete the requirements of her Undertaking Agreement. Her refusing to complete the requirements breached the Undertaking Agreement and constituted professional misconduct.

Order under section 39 of the Health Professions Act

On September 28, 2020, the Committee made an order under s. 37.1 (3) of the Health Professions Act on terms which include that Ms. Oddoux will not apply to College for future registration until she has completed the terms of the Undertaking Agreement, and that the College may refuse her registration if it receives an application for registration before she has completed the terms of the Undertaking Agreement.
